Za efikasnije ostvarivanje Ombudsmanovih preporuka
Transparentnost – Srbija predlaže Narodnoj skupštini da, prilikom razmatranja godišnjeg izveštaja Zaštitnika građana na jasan način odluči o tome šta će uraditi da bi se problemi na koje je Ombudsman ukazao rešili.
Nezavisni državni organi redovno dostavljaju svoje godišnje izveštaje i ukazuju na ozbiljne probleme, čije rešavanje često zahteva ili izmenu propisa ili delotvoran nadzor Skupštine nad izvršnom vlašću. Sprovođenje ovih preporuka u delo bi bilo od velike koristi borbi protiv korupcije. Međutim, Skupština do ove godine izveštaje nezavisnih organa nije razmatrala.
Smatramo da je prvi test primene novog skupštinskog Poslovnika bio samo delimično uspešan. Odbori Narodne skupštine su „probili“ 30-dnevni rok za razmatranje izveštaja Zaštitnika građana, Državne revizorske institucije i Agencije za borbu protiv korupcije. Takođe, po Poslovniku, Narodna skupština je trebalo da razmatra u plenumu izveštaje nezavisnih organa i zaključke odbora na prvoj narednoj sednici, a to je učinjeno sa dve sednice zakašnjenja.
Međutim, daleko veći problem od kašnjenja jeste način razmatranja, a pre svega, način formulisanja zaključaka. Iako je Skupština dala podršku radu nezavisnih državnih organa i njihovim izveštajima (Poverenik za informacije, Antikorupcijska agencija, Državna revizorska institucija), iz skupštinskih odluka se ne može videti šta će konkretno biti učinjeno da se uočeni problemi reše.
Naglašavamo da će novu priliku da postupi drugačije Narodna skupština imati u utorak, 19. jula, kada bude razmatrala izveštaj Zaštitnika građana. Smatramo da bi Narodna skupština trebalo tokom ove rasprave da utvrdi na koji način će izvršiti ili pratiti, između ostalog, izvršenje sledećih preporuka Ombudsmana:
Preporuke koje se odnose na neposredno postupanje Narodne skupštine
- Potrebno je da Narodna skupština u Poslovnik unese i odredbe o saradnji sa Zaštitnikom građana i drugim nezavisnim kontrolnim organima.
- Potrebno je da Narodna skupština zatraži od Visokog saveta sudstva da počne izvršavati zakonom propisanu obavezu saradnje sa Zaštitnikom građana u postupcima iz njegove nadležnosti.
- Potrebno je da nadležni odbor Narodne Skupštine razmotri poseban izveštaj Zaštitnika građana o preventivnoj kontrolnoj poseti Bezbednosno – informativnoj agenciji.
- Potrebno je da Narodna skupština razmotri i podrži primenu Kodeksa dobre uprave koji joj je dostavio Zaštitnik građana.
- Potrebno je da Narodna skupština razmotri izveštaj o slučaju „nestalih beba“ koji joj je dostavio Zaštitnik građana.
- Potrebno je da Narodna skupština istakne značaj pune i efikasne zaštite aktivista i organizacija civilnog društva koji se zalažu za unapređenje poštovanja ljudskih prava i pozove na stvaranje podsticajne atmosfere za njihov rad
- Potrebno je da Narodna skupština, kroz javno slušanje ili drugi pogodan način, oceni da li treba da opstane mogućnost da zaposleni u organu javne uprave (organu državne, pokrajinske, lokalne vlasti, javnoj službi, organizaciji sa javnim ovlašćenjima...) bez posebnih mehanizama zaštite od zloupotreba mogu dopunski da rade istovrsan posao u dopunskom radu (javnom ili privatnom), a da to ne predstavlja svojevrstan konflikt interesa.
- Potrebno je da „pravo na dobru upravu“ bude uvršćeno među osnovna prava građana.
- Potrebno je izmenama zakona omogućiti punu transparentnost vlasništva nad medijima.
Preporuke koje se odnose na postupanje Vlade, čiji rad bi Narodna skupština trebalo da nadzire
- Potrebno je da Vlada odluči o Inicijativi Zaštitnika građana za izmenu čl. 50 Zakona o kulturi.
- Potrebno je da Vlada razmotri inicijativu Zaštitnika građana za normativnu razradu načina ostvarivanja Ustavne odredbe koja propisuje da se pri zapošljavanju u državnim organima, javnim službama, organima autonomne pokrajine i jedinica lokalne samouprave vodi računa o nacionalnom sastavu stanovništva i odgovarajućoj zastupljenosti pripadnika nacionalnih manjina
- Potrebno je da Vlada u budućem radu ne predlaže izmene budžeta Zaštitnika građana bez konsultacije sa njim i njegove saglasnosti, u skladu sa zakonom.
- Potrebno je da nadležni organi pojačaju delotvornost istraživanja i procesuiranja krivičnih dela počinjenih izražavanjem i prenošenjem krivično kažnjivih stavova preko Interneta.
- Potrebno je da Vlada Republike Srbije delotvornije obaveštava nadležne organe i javnost o svojim odlukama (zaključcima i dr.) koje utiču na način ostvarivanja prava građana.
- Potrebno je da Vlada bez odlaganja pristupi izradi predloga opšteg zakona o restituciji (vraćanju imovine)
- Potrebno je da nadležni inspekcijski organi u Ministarstvu finansija i drugim organima intenziviraju kontrolu uplate obaveznih doprinosa za zaposlene i preduzimaju mere protiv poslodavaca koji krše zakon.
- Potrebno je da Vlada održava pravovremen i svrsishodan socijalni dijalog sa predstavnicima poslodavaca i zaposlenih.
- Potrebno je da nadležna ministarstva pripreme izmene zakona kojima će biti uvedena obaveza raspisivanja javnog konkursa za zasnivanje radnog odnosa u svim organima i organizacijama u javnom sektoru.
- Potrebno je da Vlada, preko nadležnog ministarstva, razmotri mogućnosti za propisivanje uslova pod kojima se organizacijama civilnog društva može priznati status organizacije koja obavlja aktivnosti od opšteg interesa, i kao takvima odobriti poreske olakšice.
