Produženje važenja Zakona (o podsticanju građevinske industrije), koji se nalazi na današnjem dnevnom redu Narodne skupštine, u očiglednoj je suprotnosti sa najavljenim antikorupcijskim reformama u javnim nabavkama, jer donosi veće troškove javnih nabavki, umesto ušteda, povećanje broja izuzetaka od primene Zakona umesto stvaranja celovitog sistema i jedinstvenog pravnog poretka i širu primena netransparentnih i nekonkurentnih postupaka umesto da se kroz javnost i nadmetanje ostvare uštede i javna sredstva zaštite od korupcije. Transparentnost – Srbija i Koalicija za nadzor javnih finansija predlažu skidanje sa dnevnog reda te tačke, do donošenja odluke Ustavnog suda po pokrenutoj inicijativi za ocenu ustavnosti.
Transparentnost – Srbija i Koalicija za nadzor javnih finansija uputili su danas pismo predsedniku Narodne Skupštine, g. Nebojši Stefanoviću, u kojem su od njega zatražili da predloži skidanje sa dnevnog reda tačke 5. devete sednice drugog zasedanja NS RS u 2012. godini, Predloga zakona o izmeni Zakona o podsticanju građevinske industrije Republike Srbije u uslovima ekonomske krize, koji je podnela Vlada, do donošenja odluke Ustavnog suda o inicijativi za ocenu ustavnosti Zakona čija se izmena predlaže (predmet broj predmet IUz - 1061/2010). Transparentnost – Srbija i Koalicija za nadzor javnih finansija, su 6. decembra 2012[1]. pozvale Vladu da povuče iz procedure predlog izmena i dopuna Zakona o izmeni i Zakona o podsticanju građevinske industrije Republike Srbije u uslovima ekonomske krize[2], Narodnu skupštinu da ne usvoji taj predlog a Ustavni sud da se što pre izjasni o ustavnosti tog akta.
Zakon o podsticanju građevinske industrije Republike Srbije u uslovima ekonomske krize, koji je usvojen 2010. ("Službeni glasnik RS", br. 45/2010, 99/2011) je, po našoj oceni, suprotan načelima Ustava, kao i Sporazumu o stabilizaciji i pridruživanju i Sporazumu CEFTA, koji po našem Ustavu imaju veću pravnu snagu od domaćih zakona, i kao takav nije ni smeo da stupi na snagu. Koalicija za nadzor javnih finansija i Transparentnost – Srbija uputili su pre dve i po godine, 7.7.2010. inicijativu za osporavanje ustavnosti ovog akta[3]. Ustavni sud je još 11. novembra 2010. godine zatražio od Narodne skupštine izjašnjenje o ovoj inicijativi[4], ali se u poslednje dve godine nije oglašavao ovim povodom. Važenje zakona je u doba prethodne Vlade produženo do isteka ove godine, a sada se čak predlaže da se on primenjuje do kraja 2014.
Ovaj zakon je takođe direktno suprotan osnovnim načelima sistemskog Zakona o javnim nabavkama (obezbeđivanje konkurencije i jednakost ponuđača), čime se narušava pravni poredak zemlje. Umesto sprovođenja otvorenog tenderskog postupka, ovim zakonom se predviđa „pregovarački postupak bez objavljivanja javnog poziva“ sa odabranim firmama, što umanjuje mogućnost javnosti da zna sve važne elemente tog postupka.
Osim što je suprotan Ustavu, ovaj zakon dovodi u primeni do povećanja javnog duga zemlje, a sve radi finansiranja projekata koji su u praksi bili široko korišćeni radi promocije republičkih i lokalnih lidera u doba predizborne kampanje. Paradoksalno, u obrazloženju predloga da se primena Zakona produži još dve godine tvrdi se da „za potrebe sprovođenja ovog zakona nije potrebno obezbediti finansijska sredstva iz budžeta“!
Činjenica da je ovakav predlog uopšte mogao da bude upućen u skupštinsku proceduru pojačava sumnje u to da postoji koordinacija i sistemski pristup u antikorupcijskoj politici Vlade, čiji predstavnici s pravom stavljaju sprečavanje zloupotreba u javnim nabavkama u prvi plan svoje akcije. Nasuprot tome, predlažu produženje važenja propisa kojim su njihovi prethodnici na najgrublji način narušili sistem javnih nabavki.
Pored svega navedenog, produženje važenja Zakona o podsticanju građevinske industrije Republike Srbije u uslovima ekonomske krize, je u direktnoj suprotnosti i sa predlogom novog Zakona o javnim nabavkama koji je grupa od 138 narodnih poslanika podnela 7. decembra 2012. godini.[5] Predlog novog Zakona o javnim nabavkama[6], između ostalog, kao meru u tom cilju predviđa „smanjenje broja izuzetaka od primene zakona“, dok se kao jedan od problema u sadašnjem pravnom okviru uviđa „široka mogućnost upotrebe pregovaračkog postupka“.
Usvajanje zakona koji se nalazi na današnjem dnevnom redu Narodne skupštine bi očigledno vodilo ostvarivanju potpuno suprotnih ciljeva: veći troškovi javnih nabavki, umesto ušteda; povećanje broja izuzetaka od primene Zakona umesto stvaranja celovitog sistema i jedinstvenog pravnog poretka; šira primena netransparentnih i nekonkurentnih postupaka umesto da se kroz javnost i nadmetanje ostvare uštede i javna sredstva zaštite od korupcije.
