Za izborne kampanje bez korupcije i zloupotrebe javnih resursa
Organizacija Transparentnost Srbija (ogranak međunarodne mreže Transparency International), uputila je nedavno osnovanom Nacionalnom ogranku međunarodne inicijative parlamentaraca za borbu protiv korupcije (GOPAC)[1] u Narodnoj skupštini Republike Srbije inicijativu za formiranje Nadzornog odbora, u skladu sa članovima 99. i 100. Zakona o izboru narodnih poslanika[2].
Smatramo veoma značajnim da upravo GOPAK grupa inicira formiranje Nadzornog odbora, koji i pored zakonske obaveze, Skupština nije formirala još od parlamentarnih izbora iz decembra 2000. Da je Nadzorni odbor formiran i da je Skupština ostvarila svoju funkciju ovo telo moglo bi da pravovremeno ukaže na zloupotrebe javnih resursa u izbornoj kampanji, ali i da utiče da drugi državni organi kvalitetno urade svoj deo posla tokom kampanje (RRA, Agencija za borbu protiv korupcije, RIK)[3]. Na svim dosadašnjim izborima, opozicija je s pravom ukazivala na to da je propust da se formira Nadzorni odbor pogodovao pojedinim vidovima zloupotrebe javnih resursa. Transparentnost – Srbija je tokom izborne kampanje 2012 identifikovala korišćenje navodno redovnih aktivnosti državnih funkcionera za partijsku promociju u medijima kao jedan od najkrupnijih problema. Smatramo da taj problemnije adekvatno rešen postojećim propisima i kontrolom državnih organa.
Nema prepreke da se članovi Nadzornog odbora izaberu, iako parlamentarni izbori nisu raspisani, jer to telo može početi sa radom kada kampanja bude počela, a moglo bi da da svoj doprinos i u vezi sa skorašnjim lokalnim izborima u Gradu Beogradu[4].
Transparentnost Srbija je u dopisu pozvala sve članove GOPAK-a i njihove poslaničke grupe da demonstriraju raskid sa dosadašnjom praksom nepoštovanja zakona i na ovaj način daju svoj doprinos jačanju antikorupcijskih mehanizama. Takođe smo predložili članovima GOPAK i njihovim poslaničkim grupama da razmotre šta narodni poslanici mogu da učine kao bi se rešili drugi problemi korupcije i zloupotrebe javnih resursa u izbornoj kampanji, na osnovu prioriteta za dalje postupanje prema mišljenju TS[5], a koji nisu rešeni u proteklih mesec i po dana.

[4] Formiranje Nadzornog odbora neće stvoriti ni teret za budžet, ukoliko se ne bi predvidele naknade za članove.
[5] Saopštenje za javnost TS od 4. oktobra 2013. Kao prioriteti za rešavanje pre raspisivanja beogradskih izbora su istaknuti sledeći:
1. Da Agencija za borbu protiv korupcije dovrši kontrolu finansijskih izveštaja o izbornoj kampanji iz 2012, pokrene postupke u svim utvrđenim slučajevima kršenja Zakona i javnosti predoči podatke o tome. Objavljivanje ovih podataka delovaće, prema oceni TS,preventivno protiv kršenja pravila u novoj izbornoj kampanji ali će takođe dati biračima bitno obaveštenje o prethodnom poštovanju antikorupcijskih propisa.
2. Da policija i javno tužilaštvo pre raspisivanja izbora saopšte šta su uradili na ispitivanju svih krivičnih dela o za koja su se politički takmaci međusobno optuživali tokom prethodnih izbora, a naročito u vezi sa nepravilnostima u vezi sa brojanjem glasova, kupovinom glasova i zloupotrebom javnih resursa.
3. Da se preciznije uredi praksa promocije kandidata na izborima i lidera stanaka koji su ujedno i javni funkcioneri tokom izborne kampanje. Monitoring Transparentnosti – Srbija je 2012 utvrdio kod ondašnjih funkcionera povećanje učestalosti „redovnih“ aktivnosti od neverovatnih 2 do 17 puta u odnosu na neizborni period. Vanredni lokalni izbori u poslednjih godinu dana pokazuju nastavak ove prakse. To uključuje naročito potpisivanje sporazuma sa investitorima, otvaranje javnih objekata, posete gradilištima, podelu socijalne pomoći i druge događaje. Ako je nužno da se takve stvari rade u doba kampanje, prisustvo političara svakako nije neophodno – to mogu učiniti javni službenici koji ne učestvuju u izbornoj kampanji.
4. Da se što pre izmene medijski propisi, tako da,za razliku od sadašnjeg stanja,obezbede javnost vlasništva, način finansiranja i javnost podataka o većim finansijerima medija a da Republička radiodifuzna agencija pravovremeno reaguje na sve slučajeve programskog ili finansijskog favorizovanja koji su protivni zakonu i obavezujućim uputstvima RRA.
5. Da se preciziraju norme u Zakonu o finansiranju političkih aktivnosti, naročito u oblastima koje su se na prošlim izborima pokazale kao sporne – plaćanje troškova nakon kampanje, krediti, humanitarne aktivnosti stranaka i pravno nejasan status grupa građana.
6. Da se u roku od 48 sati objavljuju podaci o trošenju budžetskih sredstava, preuzimanju finansijskih obaveza i zapošljavanju u državnoj i lokalnoj upravi, javnim službama i preduzećima u doba kampanje i da se ovi procesi podvrgnu posebnoj kontroli, pošto su do sada često služili političkoj promociji i kupovini podrške birača.
7. Da izborni programi učesnika budu objavljeni na početku kampanje, kako bi bilo dovoljno vremena da stručnjaci daju komentare, ali i da bi stranke pružile razumno obrazloženje načina ostvarivanja predizbornih obećanja i finansiranja najavljenih aktivnosti.
