O slučaju RTS/Dajrekt medija
Obilje vesti o istrazi koju je otvorilo Tužilaštvo za organizovani kriminal protiv nekoliko zaposlenih u RTS, firmi Direct media i protiv te firme kao pravnog lica, još uvek nisu dovoljne da bi se moglo zaključiti na šta tačno tužioci sumnjaju. Naime, kako je saopšteno, za sve njih je izneta sumnja da su počinili krivično delo „zloupotreba položaja odgovornog lica“.
U poslovnim odnosima, ono što je interes jedne strane, uglavnom je suprotno poslovnom interesu druge, a ugovor odražava tačku na kojoj postignu saglasnost. Tako, ako su zaposleni u RTS svesno zaključili neki ugovor koji šteti javnom servisu, jasno je da oni mogu da odgovaraju zbog toga što nisu vršili ono što je njihova dužnost, zato što su prekoračili svoja ovlašćenja ili zato što su ta ovlašćenja namerno iskoristili da bi doneli korist drugoj ugovornoj strani. S druge strane, predstavnici privatne firme, kada ugovaraju dobar posao za svoju firmu, ne zloupotrebljavaju ovlašćenja, već rade upravo ono što im je posao. Druga je stvar ako se radi dobijanja unosnog posla koriste nedozvoljenim sredstvima, na primer, davanjem mita. Međutim, da je to bio slučaj, onda bi se istraga vodila zbog davanja mita, kao konkretnijeg krivičnog dela, a ne za „zloupotrebu položaja odgovornog lica“, koja se goni samo onda kada „nisu ostvarena obeležja drugog krivičnog dela“.
Odgovor na ovu nelogičnost bi možda moglo da bude to da su tužioci u stvari mislili na na „podstrekavanje“ ili „pomaganje“ predstavnika RTS da počine krivično delo, ali da to nisu saopštili. Podstrekavanje je preduzimanje radnje kojom se kod drugog lica s umišljajem izaziva ili učvršćuje odluka da preduzme protivpravnu radnju. Ukoliko je to slučaj, onda bi se istraga vodila oko toga da li se neka radnja (npr. poziv da se zaključi ugovor koji će više koristi jednoj strani) mogla smatrati „podstrekavanjem da se izvrši krivično delo“ ili bi za tako nešto morali postojati neki čvršći pokazatelji (npr. obećanje poklona). Međutim, ukoliko bi postojali dokazi davanja poklona u vezi sa zaključenjem određenog ugovora, onda bi bila reč o drugom krivičnom delu, a ne o „zloupotrebi ovlašćenog lica“.
Stvari nisu mnogo jasnije ni kada se pogledaju konkretni navodi iz izjave ministra unutrašnjih poslova. Iako je konferencija za štampu ministra Stefanovića održana u njegovom službenom kapacitetu, i najavljena na sajtu MUP-a, ono što je ministar govorio uopšte se ne može pročitati na tom mestu! Izjave ministra je sa druge strane, prenela stranka u kojoj je potpredsednik, kao i mnogi mediji. U izveštaju sa sajta RTS navode se neki od detalja. Ministar tvrdi da su uhapšeni „oštetili Javni servis i građane Srbije za 688 miliona dinara, a krivično delo izvršili u peridu od avgusta 2009. do 2018. godine,“ da se sumnjiče kako „su zajedničkim delovanjem učestvovali u zaključivanju više ugovora o poslovnoj saradnji i aneksa tih ugovora, suprotno zvaničnim cenovnicima RTS-a“, da je „'Dajrekt medija', pored popusta na cene, dobila i pravo na broj sekundi i grpijeva bez naknade, na koji način su po osnovu finansiranja Lige šampiona i Lige Evrope u periodu od 2009. do 2018. godine, kao i dve TV serije Nepobedivo srce i Moj rođak sa sela 2 pribavili protivpravnu imovinsku korist Dajrekt mediji u ukupnom iznosu od 248.965.540 dinara, a na štetu građana Srbije".
Pored toga što postoji razlika u iznosima moguće štete po RTS (688 ili 249 miliona dinara), ova izjava ukazuje na moguću protivpravnost zaključenih ugovora – to što su zaključeni suprotno zvaničnim cenovnicima i što je pored popusta RTS dao nešto bez naknade drugoj ugovornoj strani. Međutim, ovo objašnjenje stvara nova pitanja. Naime, ako ugovarači na strani RTS nisu bili ovlašćeni da prodaju oglasno vreme suprotno cenovnicima, onda su ti ugovori ništavi, a verovatnoća da su kao takvi opstali godinama bez znanja rukovodstva RTS, upravnog odbora i revizora nikakva, pa bi i oni morali biti obuhvaćeni krivičnom istragom. Ako zaposleni jesu bili ovlašćeni da zaključuju ugovore i po drugim cenama, onda je ministrova opaska o „zaključivanju ugovora suprotno zvaničnim cenovnicima“ bez pravnog značaja, ali bi ostao prostor za ispitivanje da li je je ovlašćenje bilo korišćeno protivno svrsi.
